Welcome to motocapture.jpg, These Terms of Service Govern your access to and use of our motorbike photography services, website, and related products (collectively, the “Services”). By booking a session, purchasing images, or using our Services, you agree to be bound by these Terms.
1. Services Provided
Photography Sessions: We provide professional photography services specializing in motorbikes, riders, and related events.
Image Delivery: Final images are delivered digitally in high resolution via [download link, gallery, or email]. Physical prints may be available upon request.
Customization: Additional editing, retouching, or special requests may be subject to additional fees.
2. Booking & Payment
Booking Confirmation: A booking is confirmed only once a deposit or full payment has been received.
Deposits: Deposits are non-refundable unless we cancel the session.
Payment Terms: Full payment must be completed before delivery of the final images.
Cancellation & Rescheduling: Clients must provide at least 48 hours’ notice to reschedule. Cancellations without sufficient notice may forfeit the deposit.
3. Client Responsibilities
Permissions: Clients are responsible for ensuring that motorcycles, riders, and locations photographed are legally permitted for photography.
Safety: Clients must prioritize safety during photography sessions. We will not be held responsible for accidents, injuries, or damages occurring during a shoot.
Timeliness: Clients must arrive on time to scheduled sessions. Delays may reduce the length of the session without refund.
4. Intellectual Property & Usage Rights
Ownership: We retain full copyright ownership of all photographs taken.
Client License: Upon full payment, clients are granted a non-exclusive, non-transferable license to use the images for personal, non-commercial purposes (e.g., social media, prints).
Commercial Use: Any commercial use (sponsorships, ads, merchandise, etc.) requires a separate licensing agreement.
Credit: When sharing on social media, we request credit be given as “Photography by motocapture.jpg.”
5. Refunds & Satisfaction
Refund Policy: Due to the creative nature of photography, all sales are final. Refunds are not provided once images have been delivered.
Re-shoots: If technical errors (e.g., corrupted files) prevent delivery, we will arrange a re-shoot at no additional cost.
6. Liability
We are not responsible for:
Accidents, damages, or injuries during a session.
Loss or damage of personal property during a session.
Circumstances beyond our control (e.g., weather, traffic, equipment failure).
Our liability is limited to the amount paid for the Services.
7. Privacy & Data Protection
Client data (names, emails, and photos) will be stored securely and used only for providing Services.
We will not sell or share client data without consent, except as required by law.
We may use selected images for promotional purposes (website, social media, portfolio) unless clients opt out in writing.
8. Changes to Terms
We reserve the right to update or modify these Terms at any time. The latest version will always be available on our website. Continued use of our Services constitutes acceptance of the updated Terms.
